| Legal Aspects of Interrogation Sonny McAfee teaches this eight hour course that covers Fifth Amendment issues during custodial interrogation as well as specific requirements of 38.22 of the Texas Code of Criminal Procedure. The course examines when Miranda warnings are required, interrogation after invocation of right to silence, and invocation of the right to counsel under the Fifth Amendment. Issues that arise when the Sixth Amendment right to counsel are covered, including when the right attaches, when an interrogation may occur after the right has attached and how to obtain a waiver of the Sixth Amendment right.
