LEGAL ASPECTS OF INTERROGATION

The Legal Aspects of Interrogation class covers Fifth Amendment issues during
custodial interrogation as well as specific requirements of 38.22 of the Texas
Code of Criminal Procedure.  The course covers Miranda requirements,
interrogation after invocation of right to silence, and implications of invocation
of the right to counsel under the Fifth Amendment.  

Additionally, issues that arise when the Sixth Amendment right to counsel has
attached are covered, including when the right attaches, when the right is
invoked, when an interrogation may occur after the right has attached and how
to obtain a waiver of the Sixth Amendment right.  

The course emphasizes strategies for lawfully interrogating the suspect while
fully providing constitutional rights, and complying with the law of Texas.  
Recent U.S. Supreme Court law expanding investigators’ abilities to contact
defendants following arraignment who have already requested or received
counsel are discussed.
